Ambassador Forejudged Neighbor’s Flat

A citizen of Ukraine bought a flat on Pushkinskaya Street in 2003. The previous owner has this flat as his private property according to gift contract.

The new owner received a request for summons in 2007. Her neighbor who brought a case before the court is one of the ambassadors of Ukraine. His honor ambassador extraordinary and plenipotent demanded to invalidate the buy and sell agreement. The argument for such a demand is following: the neighbor has a preference to buy this flat.

Such statement looks rather sophisticated because only the owner of the flat has undivided right to own, to use and to dispose of property in the way he or she wants to. Only the owner has a right to decide to whom he is going to sell his own flat.

If the decision of court of primary jurisdiction remains valid – we will have an unprecedented practice, when the owner of the flat has to offer for his neighbors to buy his flat before selling it to real customer.
